I am interested in promoting online casino sites such as poker sites, etc. However, I have been informed that this is against the law in the US.
Is this true? I do not want to break any laws or wind up in prison. I live in Canada. |

Hello Ron,
I will start by saying that I am not a lawyer, and this is not legal advice.
Having said that, my understanding is that under the Criminal Code of Canada, it illegal to advertise games of chance or mixed skill and chance.
Games of chance include scratch-and-win tickets and mixed skill & chance would be games such as poker.
However, you've probably noticed that PartyPoker (.net) advertises on Canadian TV all day long. They get around that because they promote free "learn to play" poker sites.
If you are concerned about attracting U.S. players, the Unlawful Internet Gambling Enforcement Act of 2006 put the onus on banks to disallow transactions through gambling sites. When the Act was introduced, many casinos withdrew from the U.S. market, however many others just included the following fine print on their sites:
| Quote: | | Before playing in our real money games, please check with your local jurisdiction regarding the legality of Internet gaming. |
Another aspect to consider before you start promoting casinos or online gambling as affiliate is that Google does not permit advertising for the promotion of online casinos and gambling activities.
From their website...
This includes, but is not limited to, the following:
sports books
lotteries
bingo
poker
sites that provide tips, odds, and handicapping
software facilitating online casinos and gambling
gambling tutoring online
gambling related eBooks
'play for fun' gambling or casino games of skill including sites where the primary purpose is 'play for fun' gambling
affiliate sites with the primary purpose of driving traffic to online gambling sites
I hope that helps!
Cheers,
Ros |
